The EU AI Act reaches a critical milestone this year when requirements for high-risk AI systems come into full force. Colorado's new AI Act takes effect. Courts are establishing precedent on algorithmic accountability. And perhaps most significantly: "the algorithm made the choice" is no longer a valid legal defense.
For executives who've been treating governance as a checkbox exercise, this is a wake-up call. For those who've been building governance capabilities, it's the moment competitive advantage emerges.
Why Most Organizations Aren't Ready
The gap between governance theater and governance reality is wider than most leaders realize.
What most companies have:
- A written AI policy (often generic, rarely enforced)
- Some training completed (usually one-time, often forgotten)
- A verbal commitment to "responsible AI"
What most companies lack:
- Real-time visibility into what AI systems are actually doing
- Clear accountability chains when things go wrong
- The ability to explain decisions to regulators or courts

- Documentation that would survive an audit

Speed to deployment: Systems with governance infrastructure built in can ship faster because they've already passed internal review.
Customer trust: B2B buyers increasingly require AI governance documentation before signing enterprise deals.
Regulatory leverage: When regulators come asking (and they will), organizations with mature governance programs negotiate from strength.
Talent retention: Top AI talent wants to work somewhere their work won't blow up in the news.
Insurance costs: AI liability insurance (yes, that's a thing now) is cheaper for organizations that can demonstrate governance maturity.
The Three Questions to Ask This Week
Before your next board meeting or AI review, get honest answers to:
